Vic: Bisexual footy trainer loses discrimination case

MELBOURNE, Feb 19 AAP - A bisexual sports trainer who launched a discrimination case
against a country football league had his case kicked out by the Victorian Civil and Administrative
Tribunal (VCAT).

VCAT senior member Noreen Megay told 42-year-old Ken Campagnolo his case against the
Benalla and District Football League and the Bonnie Doon Football Club did not have "a
scintilla of credibility".

"In my view this action is entirely misconceived and manifestly hopeless," Ms Megay
said on Thursday.

The former Department of Sustainability and Environment (DSE) firefighter had claimed
that publicity surrounding his accusations of bullying in the DSE because of his sexuality
led to him losing his training role at Bonnie Doon.

"It is not in dispute that the club told him he could not continue as a trainer although
it maintained it welcomed him generally," Ms Megay said.

VCAT found that Mr Campagnolo had not been employed by the league or the club but had
received a free entry pass to games and transport expenses.

It said that Mr Campagnolo, who was unrepresented in the hearing, had not been able
to prove his assertion of employment by the league or the club.

"I am satisfied that the action brought by Mr Campagnolo against the Benalla and District
Football League lacks even a scintilla of credibility," Ms Megay said.

21 July 2011 - German software and consultancy firm Norcom Information Technology (ETR:NC5) said today it will enter into agreements with DB Systel for three out of four lots under the European Union procurement framework IT Productions and Support (ITPS).
Under the agreements, which are effective from August 1, Norcom together with other companies, will cover DB Systel's support services during several years.

The total volume of the EU procurement ITPS for the four lots is some EUR30m (USD42.5m) a year, DB Systel said. Norcom estimates that they can generate revenue of EUR3m to EUR5m a year.

DB Systel is the internal services provider of German railway operator Deutsche Bahn AG. It is responsible for the execution of the ICT projects and the support of the ICT applications of Deutsche Bahn.

NSW:Officers to vote against radical action

The police union is expected to vote against ramping up industrial action against the
New South Wales government's changes to the death and disability scheme.

Last month officers voted in support of escalating their action to only responding
to urgent or life-threatening situations.

But the executive of the state's Police Association is expected to vote against the
move at a Sydney meeting today after a warning from the Industrial Relations Commission
that a police pay claim would be blocked while the union continues its action.

An association spokesman says it's likely the executive will decide that now is not
the time to escalate industrial action, but says the association will continue to campaign
against the changes to the death and disability scheme up to the next state election.

A self-confessed cannibal has been jailed for life .. after he murdered his flatmate
in a scene likened to an abattoir killing floor.

ROBERT IAN LOGAN admitted to killing BEN HUNTINGFORD in June 2006 .. but pleaded not
guilty to murder in the Supreme Court in Brisbane.

But a jury's found the 23 year old guilty of a murder described by prosecutors as a
"brutal slaughtering" at the home they shared at Beenleigh .. south of Brisbane.

The court heard LOGAN told police he cut Mr HUNTINGFORD'S throat from ear to ear ..

and watched him drag himself to the bedroom .. where he later died.

He then drank some of Mr HUNTINGFORD'S blood.

SYDNEY, Aug 5 AAP - Federal Opposition Leader Tony Abbott's economic plans are "dodgy
brothers economics", Treasurer Wayne Swan says.

"What Mr Abbott has demonstrated time and time again is what a risk he poses to our
national economy," Mr Swan told reporters in Sydney on Thursday.

"He doesn't have an economic plan and he most certainly doesn't have a fiscal strategy."

Mr Swan said Mr Abbott so far had chalked up $21 billion of uncosted spending commitments
and submitted less than 1.5 per cent of those commitments to Treasury scrutiny.

"This is dodgy brothers economic shambles from the Liberal Party, nothing more and
nothing less," Mr Swan said.

The coalition was in the process of "eroding our surpluses", he added.

This comes as Prime Minister Julia Gillard's invitation to a debate about the economy
continues to be rejected by Mr Abbott.

Mr Abbott said the prime minister had her chance at debating him and he won't disrupt
his campaign now because the Labor campaign was struggling.

Meanwhile, the unions believe that a coalition government will put around 100,000 manufacturing
jobs at risk.

The leaders of the Australian Workers Union (AWU) and the Australian Manufacturers
Workers Union (AMWU) said on Thursday that an Abbott government will cut industry assist
programs such as Enterprise Connect and slash the Green Car fund.

"States like Queensland could see 18,400 jobs disappear while in NSW up to 30,000 jobs
could disappear," AWU national secretary Paul Howes said.

"Tony Abbott's ideological hatred of government programs will see him kill off important
assistance to our manufacturing sector."

SYDNEY, Dec 24 AAP - The captain of the Sea Shepherd group's anti-whaling ship says
he is confident he will be able to locate a Japanese whaling fleet, despite a Japanese
security vessel chasing and harassing him and his crew.

Paul Watson, captain of the Steve Irwin, says the Shonan Maru 2 has been harassing
his ship in Antarctic waters for almost a fortnight while it attempts to prevent his crew
from pursuing the Japanese whaling fleet.

The Ady Gil, a 24-metre trimaran speedboat belonging to the Sea Shepherd, met up with
the Steve Irwin on Thursday, and circled the Shonan Maru 2 to create a diversion and help
the Steve Irwin to lose the Japanese ship.

The Steve Irwin then managed to steam ahead of the Shonan Maru 2 by 12 miles but the
security vessel eventually caught up.

Mr Watson says his crew will return to Hobart for fuel, then continue their pursuit
of the Japanese whaling fleet.

"We usually don't find the fleet until the first week of January," he told the Seven
Network on Thursday.

"We are still a week ahead of schedule.

"I'm confident that (the Steve Irwin) will find them ... and I'm sure that we'll cut
into their quotas.

"We've made sure they haven't got their full quotas for three years. They haven't made
a profit for three years.

"They are $100 million in debt.

"And I think that that is the language they understand. We've got to bankrupt them.

we've got to sink them economically."

WA: Pomersbach escapes jail term over police assault charges

PERTH, Aug 14 AAP - West Australia cricketer Luke Pomersbach has been fined a total
of $3,500 after admitting to multiple charges including assaulting a police officer and
attempting to escape from custody.

Pomersbach, 24, has already been suspended indefinitely by the West Australian Cricket
Association after he was involved in a car accident in the Perth beachside suburb of Scarborough
on Sunday night.

He assaulted one of the officers who tried to arrest him after the accident, leading
to him being taken to hospital with minor injuries.

Pomersbach pleaded guilty to six charges in Perth Magistrates Court on Friday including
driving with a blood alcohol level in excess of .08 and obstructing police.

Pomersbach's lawyer told the court he had already been punished through the suspension
of his contract with the WACA, with the likely loss of his private sponsorship and with
the publicity surrounding his case.

Numerous character references were handed up to Magistrate Libby Woods including from
Test opening batsman Justin Langer, Test wicketkeeper Adam Gilchrist, former Test all-rounder
Tom Moody and Test opener Geoff Marsh.

Miss Woods said she took into account evidence from the police officer who was attacked
that he had received only minor injuries after being pushed by Pomersbach.

These included a bump to his head, scratches to his elbows and damage to his thumb.

She said while any assault on a police officer was a serious matter it was at the lower
end of the scale.

She fined Pomersbach a total of $2,000 on the assault and escape lawful custody charges,
and $1,500 on the traffic offences.

MELBOURNE, April 4 AAP - He's only 17 but a quest to break the world record for the
youngest person to sail solo around the globe has pushed Mike Perham to navigate some
of the most treacherous seas in pursuit of his dream.

The English teenager, who docked in Hobart in Tasmania on Saturday, has had his share
of hairy moments since he set out from Portsmouth in the United Kingdom last November.

One such moment came just a week ago near Cape Leeuwin, off the coast of Western Australia.

"I was knocked down by a freak wave, which picked up the boat and tipped her on her
side, which was quite a scary moment," Perham told AAP on Saturday.

"Those two seconds were the scariest of the whole trip by far."

Luckily, the boat quickly righted itself and Mr Perham sailed on.

There have also been frustrating setbacks.

Perham hoped to complete the trip in five months but spent a month in the Canary Islands
sourcing a new auto-pilot for the Open 50 yacht, Totallymoney.com, and another month in
Cape Town, South Africa fixing the rudder.

After already spending five months on the seas, he now expects to reach home in nine-and-a-half
weeks.

"I've poured by heart and soul into this project. I've genuinely given it my all, and
to succeed and finish will put the biggest smile on my face," he said.

Perham sailed into Hobart on the yacht about 1.30am (AEDT) on Saturday where he met his father.

The pair worked on repairs to the yacht on Saturday afternoon.

Perham left Portsmouth on November 15 last year and hopes to raise about $A50,000 for
two charities, Save the Children and Tall Ships Youth Trust, which gives children in deprived
cities a chance to experience sailing.

The teenager became the youngest person to sail across the Atlantic single-handedly
in 2006-2007 at the age of 14.

His latest adventure is expected to cover over 40,000km and must be completed entirely
under sail by wind and muscle power to meet the requirements to set the world record.

After he returns to the UK, Perham expects to finish his college degree in sports performance
and excellence and pursue a career in - of course - sailing.

If he succeeds in his quest, Perham will break the world record set by Jesse Martin,
who became the youngest person to sail around the world unassisted at the age of 18 on
October 31, 1999, when he returned to Melbourne after a 328-day journey.

Qld: Search resumes for missing 8-year-old

BRISBANE, Dec 1 AAP - The search for an eight-year-old boy who has been missing since
being struck by a speedboat at Tinana Creek, near Maryborough, north of Brisbane on Sunday,
will resume this morning.

A search began immediately after the boy, who was paddling on a surfboard, was struck
by the ski boat and failed to surface at around 11am (AEST).

Despite the efforts of witnesses, emergency service volunteers, police divers and a
helicopter, he could not be located.

Police said the boy and his parents were members of a church group that had spent the
weekend camping on a property adjoining a popular stretch of the creek used for water-skiing,
swimming and boating.

Federal energy minister MARTIN FERGUSON admits the carbon emissions trading scheme
will possibly push up petrol prices.

Mr FERGUSON has told ABC tv energy generally will potentially increase in price.

Companies have said in submissions to the Garnaut Review that a carbon price would
push up petrol prices by 10 to 17 cents a litre.

However consumer affairs minister CHRIS BOWEN is remaining non-committal on whether
petrol will be included or excluded from the scheme to be introduced in 2010.

He's told Sky News they're still working through all the issues.

CANBERRA, Dec 23 AAP - Former West Australian premier Sir Charles Court has been hailed
as one of the most influential figures in his state's history following his death at the
age of 96.

Sir Charles, who served as premier of WA from 1974 to 1982, passed away peacefully
at home last night with his family by his side.

The Court family has accepted the offer of a state funeral.

Political luminaries today praised Sir Charles as one of the architects of Western
Australia's record period of prosperity.

WA Premier Alan Carpenter said Sir Charles would be remembered as a giant of political
life in Western Australia - a state he helped transform, overseeing investment in the
now-booming resources industry.

"No single person in public life has had as much influence in the development of Western
Australia in the last 50 or 60 years," Mr Carpenter said.

Sir Charles oversaw the development of WA's iron ore industry in the 1960s, bauxite
and mineral sands mining in the southwest, as well as nickel and smelting during his time
as industrial development minister under premier Sir David Brand in the 1960s.

"He carried on that work as premier when he played a key role in the birth of the North
West Shelf natural gas industry," Mr Carpenter said.

"These developments completely transformed the West Australian and Australian economies."

Federal Opposition Leader Brendan Nelson said he was saddened at the news of Sir Charles' death.

"He was a patriarch, not only of a proud family, but also of the Liberal Party and
the modern Western Australia," Dr Nelson said in a statement.

"His eight years as premier will be remembered for his staunch defence of states' rights
and also for his support for the Australian flag and Australian monarchy."

Governor-General Michael Jeffery, a former Special Air Service commander, paid special
tribute to Sir Charles' military career during World War II.

"Amongst his many achievements, Sir Charles had a distinguished military career during
World War II," Maj-Gen Jeffery said.

"Later he was appointed Honorary Colonel of the University of Western Australia Regiment
and Honorary Colonel of the Special Air Service Regiment."

Sir Charles believed the development of industries and population bases in northern
Australia was essential for Australia's long-term economic stability and defence, Maj-Gen
Jeffery said.

"A testament to his vision is the major contribution that Western Australia now makes
to the Australian economy."

The governor-general said Sir Charles was a loving husband and father, a genuine statesman,
passionately concerned with creating a better and safer future for the citizens of Western
Australia and the country.

WA Liberal leader Paul Omodei said it would be a long time before the state saw another
statesman of Sir Charles' calibre.

"He had an amazing physical stature and strength of mind," he said.

"He had a real presence."

Sir Charles is survived by his wife, Judy, and five sons including Richard Court, who
served as WA premier from 1993 to 2001.

Store manager BEV ELLIS says authors have come in to sign books before .. but they
don't usually just open the books and go for it.

Ms ELLIS says after Mr KING left .. she followed him into Woolworths across the road
.. telling him if she'd known he was coming .. she would have baked him a cake.

The six signed copies of his latest book .. Lisey's Story .. will be donated to charity.

ADELAIDE, April 1 AAP - An 87-year-old woman died when she was hit by a car as she
crossed a main road in Adelaide's west.

The Kurralta Park woman was hit by a car as she crossed Anzac Highway about 7.30pm
(CST) yesterday, police said.

Her death takes the state's road toll so far this year to 32, compared to 33 for the
same time last year.

Meanwhile, a man remains in a critical condition in the Flinders Medical Centre after
the van he was driving crashed into a tree at Aberfoyle Park just before 7pm yesterday.

"Once again, police urge all motorists to slow down, to drive responsibly and to the
road and weather conditions at all times," a police spokesman said.

Ms ROBERTS has declared she won't contest the seat of Gympie in the September 9 poll
.. after being worn down by six years of denigration and lies by her political enemies
in the area.

But under the Queensland Electoral Act .. no candidate can pull out once nominations close.

That happened on August 22 .. and Ms ROBERTS will appear on ballot papers.

Pre-polling began on Monday and votes may've already been cast for her.

The Act states if Ms ROBERTS is elected she'll be in her right to continue as the Member
for Gympie or resign and a by-election will be called.

The seat is tipped to go to the Nationals' DAVID GIBSON .. the former general manager

CANBERRA, April 25 AAP - Australians have been urged to be inspired by the courage
of the Anzacs and stand up against evil at a dawn service at the Australian War Memorial.

Principal Air Force chaplain (Anglican) Royce Thompson has used his address to more
than 20,000 people in the pre-dawn darkness in Canberra to draw on the Anzac legend.

Reverend Thompson said the thousands of Australian men and women serving overseas were
continuing the Anzac tradition by facing evil at every turn.

"It is a time to be inspired by their sacrifice and courage, so that we might play
our part in seeking to confront the evil in our world," he said.

"(The British statesman and philosopher) Edmund Burke once said evil prospers when
good men -- and might I add good women -- do nothing.

"We must stand against evil; we must work for peace together; we must not, we dare
not forget the Anzacs and all they stood for.

"Indeed, we must remember all who've left Australia's shores and stood in the face
of danger to combat evil, and those at home who've supported them."

Relatively mild conditions greeted the thousands of people who attended the national
service held on the war memorial's parade ground.

The memorial's head of communications, Dennis Grant, said he was especially pleased
by the large turnout at the ceremony.

"The crowds keep growing and we're gratified by the contribution that so many Canberrans
make to Anzac Day at the Australian War Memorial," he said.

In the darkness, just the crowing of some cockatoos and galahs could be heard as the
service got under way.

Later today, Anzac Parade - which leads up to the memorial from the shores of Lake
Burley Griffin - will be filled by the national Anzac Day march, which is due to be viewed
by Prime Minister John Howard and New Zealand high commissioner Kate Lackey.

Mr Howard this morning announced the war memorial and Anzac Parade would be included
on the national heritage list.

He said the war memorial was a majestic building which attracted thousands of people
every Anzac Day and up to a million visitors every year.

"By listing the Australian War Memorial and Anzac Parade on the national heritage list,
we recognise the courage of those who haver served in our armed forces, here and overseas,
in both the field of conflict and, more recently, as part of peace keeping missions in
our region," he said in a statement.

He's paid tribute to KERRY PACKER .. who died at his Sydney home last night .. aged 68.

But the prime minister says there was more to the man than his business prowess.

He says he was an influential business man .. who believed in looking after his own
interests .. and made no apologies for doing so .. but always had a concern about Australia.

Mr HOWARD says Mr PACKER was a generous .. philanthropic person and a larger than life character.

And he says he spoke to Mr PACKER'S widow .. ROS .. this morning and offered her his sympathies.

Emergency radios may improve statewide communications

WHEATON -- DuPage County's police, fire, hospital and public works crews may soon have radios designated for communicating with any emergency department statewide.Illinois will provide DuPage County with one VHF radio, said Tom Mefferd, DuPage County Homeland Security and Emergency Management director. To outfit each chief's, deputy chief's and battalion chief's vehicle with the new radios, he plans to ask the County Board for 175 more.

"We have a lot more command vehicles than radios coming from the state," Mefferd told the county Finance Committee on Tuesday.

Mefferd's request also connects more workers than the state does. While the state wants every police, fire and emergency medical services station to have a new radio, the county wants to add public works crews to that list because it counts them among its emergency responders.

"In a tornado, police and fire can't come in until public works clears the roads," Mefferd said.

The county's current communications setup already allows multiple city, county and state agencies to talk during a major emergency -- and two of the new systems got recent tests.

DuPage County used its mobile communications hub for the first time at the four-alarm roof fire at Wheaton College's Billy Graham Center on June 8. The hub, a recreational vehicle that can roll onto the site of an emergency and open up to 15 more radio frequencies, connected the county's emergency management command center with the Wheaton police and fire departments and the Wheaton College administration and security departments.

"It's not uncommon for a police officer in Community A to have a problem when a police officer in Community B just across the border has no idea because they can't communicate," Mefferd said.

Finance Committee member William Maio, R-Itasca, wondered whether agencies get kicked off if channels get too crowded during an emergency. Mefferd said the command center can control which agencies to keep connected.

The county also tested its satellite- and Internet-based notification system for hospitals and law enforcement during the nationwide bioterrorism exercise staged in May 2003. The system went live Sunday with a printed message about the rise in the terrorism threat level for certain financial institutions on the East Coast.

Committee member Robert Schroeder, R-Naperville, asked if the lines of satellite communication are secure. Mefferd said the system is 98 percent "authenticated, verifiable and secure." Additionally, some radio channels that are not secure can be encrypted if necessary, he said.

Conway Greene plans expansion.

Conway Greene Co., a professional and legal publishing firm in South Euclid, is looking for new office and warehouse space to accommodate expected growth. The company recently won an 11-year contract from the state of Michiga n to publish its laws in hard copy and CD-ROM form, as well as on the Internet. President Barry Conway said the seven-employee company plans to add five employees by year's end. The company, now in a small office at Mayfield and Gr een roads, will seek at least 1,500 square feet of office space and a similar amount of warehouse space.

'Global E-Commerce gold rush' under way.(TOPICS)

SAN JOSE, Calif. -- E-commerce is going global as retailers cross borders with new country websites, international shipping, translations and currency conversions, says a new report from the Cisco Internet Business Solutions Group.

"The Global E-Commerce Gold Rush: How Retailers Can Find Riches Overseas," suggests that international e-tailing requires an understanding of markets' opportunities and uniqueness, as well as the organizational models balancing global and local capabilities.

For most chains, it says, foreign e-commerce is uncharted territory.

In mature markets, e-commerce has been the retail growth engine for more than a decade, the study says. But as this growth slows, retailers are looking to expand online into emerging markets.

Global e-commerce, including travel, will generate almost $1.4 trillion in 2015, based on a five-year compound annual growth rate of 13.5%, according to the Cisco group's economics and research practice.

While the United States, the United Kingdom and Japan will still command an estimated 53% of the market, the highest growth rates will be in such newer markets as Spain (37%), Brazil (29%), and China, Russia, and Mexico (all at 26%).

These trends will affect both "clicks and bricks" retailers and online-only merchants. Since 20% of online consumers do most of their shopping at sites that also have brick-and-mortar stores, chains that open outlets abroad without e-commerce capabilities "will not meet the multichannel expectations of their customers," the report says. "As a result, they will lose out on a significant share of potential customer spending."

While foreign e-commerce poses many challenges, "the size of the opportunity makes the leap worth the risk and effort," the study adds. Cisco estimates that a $50 billion retailer expanding into 11 countries across Europe, Asia and Latin America could add $7 billion in sales over five years and increase its total growth rate from 17% to 31%.

Retailers planning to open country-specific websites are advised by the report to consider the sales already being generated in the markets.

Many chains shun cross-border trade because of the complexity of global shipping, tariffs and currencies as well as the high risk of international credit card fraud, it says. But with the recent growth of such sophisticated third-party cross-border trade suppliers as FiftyOne, GlobalCollect and Borderlinx, "more and more retailers are taking advantage of global e-commerce growth without opening new country stores or websites," the report notes.

SACRAMENTO MAN PLEADS GUILTY TO POSSESSING CHILD PORNOGRAPHY.

SACRAMENTO, Calif. -- The following information was released by the United States Attorney's Office for the Eastern District of California:

United States Attorney Benjamin B. Wagner announced that Nicholas Van Brocklin Trahan, 30, of Sacramento, pleaded guilty on Friday, April 29, 2011 to possession of child pornography.

According to the plea agreement, between August 2008 and September 2008 and between November 2008 and January 2009, law enforcement observed Trahan's computer offering child pornography for download through a common file-sharing network. On February 11, 2009, law enforcement agents executed a federal search warrant at Trahan's apartment and found approximately 300 video files containing child pornography in the file-sharing program that had previously been observed by law enforcement. A second folder created by Trahan on the computer titled "nicksss" also contained images of child pornography.

Trahan is scheduled to be sentenced by United States District Judge Garland E. Burrell, Jr. on July 22, 2011, at 9:00 a.m. He faces a sentence of up to 10 years in prison, a fine of $250,000, and a life term of supervised release. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

This case is the product of an extensive investigation by the Sacramento Internet Crimes Against Children (ICAC) Task Force. The Sacramento ICAC is a federally and state funded task force managed by the Sacramento Sheriff's Department comprised of agents from federal, state, and local agencies. The purpose of the Sacramento ICAC is to investigate online child exploitation crimes, including child pornography, enticement, and sex trafficking. Assistant United States Attorney Kyle Reardon is prosecuting the case.

This case was brought as part of Project Safe Childhood (PSC), a nationwide initiative by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section, PSC mobilizes federal, state, and local resources to locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. Changing the status quo: the future of stock exchange technology in Japan.(Electronic trading in Japan)

Almost since its inception in 1878, the Tokyo Stock Exchange (TSE) has been synonymous with trading in the Japanese financial markets. Other regional bourses do exist to serve investors, but after careful merging and consolidation over the decades, the TSE remains the unquestioned benchmark.

Financial markets are perpetually changing, and the last 25 years have seen a dramatic modernization at Japan's signature bourse. These include the start of financial futures trading (1985), as well as free cross-border capital transactions (1998), which have helped unlock huge business potential. Daily trading volumes, which averaged well under 1 million shares in 2000, routinely hit 6-7 million today. All told, Japan's securities exchanges rank as the second-largest stock market in the world. The TSE is set to list itself some time in 2009.

The spread of electronic trading is largely behind the dramatic rise in volumes seen in all of the world's major bourses over the last several years--including Japan, where the TSE first introduced computerization in 1999.

The greatest shifts in the trading landscape are still unfolding, however, as the endless hunt for liquidity, convenience, and efficiency have seen the rise of Proprietary Trading Systems (PTSs), a handful of which now operate here. Algorithmic (or 'algo') trading, which is based on sophisticated software that slices up large orders to minimize market impact, has also been in use in Japan since 2004-05. And cross-network trading, including dark liquidity pools ('dark pools') has been increasing since 2006. Dark pools are used by institutional investors seeking to trade large blocks of stocks away from the traditional exchanges without incurring the usual price volatility. The scheme also offers unprecedented anonymity.

The rapid build-out of PTSs, algos, and dark pools have together made keeping up with the demand for capacity at major bourses like the TSE a top priority. The so-called 'Livedoor Shock' of February 2006 was one such watershed event in which the TSE was compelled to voluntarily shut itself down for the first time in its history for lack of capacity in handling overwhelming order flow. Eighteen months later, the 'Subprime Shock' of August 2007 saw over 11 million orders taken at the bourse, a new all-time record.

While the use of Internet-based accounts has certainly been a factor in the rise in retail stock trading, the penetration of algo trading has been the primary driver behind the increase in overall volumes--including the larger ticket institutional orders, according to TSE Senior Executive Tomoyoshi Uranishi.

"The level of trading fees at TSE is (also) one of the lowest in the world, and very suitable for algo trading. But trading speed must also be fast," he explains. "For next-generation trading systems due to come on line in 2009, the speed of order response will be less than 10 milliseconds."

Raising the bar

The rise of PTS markets is more advanced in the US and Europe, where the wave that began in the 1970s and '80s accelerated through the '90s. Currently about 40 major PTSs comprise the major US markets, while another dozen or so service Europe. Most are sponsored by major brokerage houses and investment banks. Together, they have come to constitute a credible business threat to the long-dominant bourses already there.

The NYSE estimates that more than 20% of all trades in its listed stocks are funneled through dark pools, up from just 3% to 5% two years ago. In Japan, over-the-counter (OTC) and PTS markets combined absorb just under 10% of daily market volumes, but many see that figure poised to grow dramatically.

"If the TSE does not make a big effort to respond to market needs, it could lose its share in the near future," says the TSE's Uranishi.

Instinet Japan, the largest electronic trader here, is one of the most keenly interested players in how the TSE reacts. Through its Global Direct Market Access (DMA), CBX, and other direct execution services, Instinet commands the lion's share of the off-market trading done here. So unique was its business at the time it set up in Tokyo in 1990, the type of PTS license the firm holds was originally created specifically for it. Instinet's profile began to rise on the back of the 'Livedoor Shock' as the TSE's halt left investors with few other liquid venues in which to trade.

Christian Chan, Instinet's Head of Proprietary Trading Systems in Tokyo, sees even more significant changes just around the corner. "Within the last year the market has changed significantly. An increased number of new entries are already jockeying for position. The gap in the development of e-trading technologies between the US, Europe and Japan has narrowed and is less than three years now. By 2010 the landscape is likely to look dramatically different."

New PTS players include kabu.com and Monex, both of which cater to individual investors. In the spring of 2007, SBI Holdings applied to the Financial Services Agency (FSA) for PTS approval to open an after-hours market after it established SBI JapanNext, in which Goldman Sachs Japan has a 50% stake. This new stock trading system is designed for both individual and institutional investors. Matsui Securities is also preparing to launch its own PTS with real-time settlement services where investors can instantly cash in their sales.

All go for algos

Two keys to the success of PTSs are liquidity and speed. Per transaction costs are also important, but high volume trading on the six-to-seven figure scale in which hedge funds and institutional investors engage is more dependent on achieving spreads within a desired range, and getting a trade done quickly, with few delays, and with as little adverse market impact as possible.

The advent of algorithms has enabled large-volume trading to realize another quantum leap in efficiency by allowing software to make multiple decisions about when, how much, and at what price a given amount of a security should be traded, removing much of the number-crunching and time-consuming analytical toil. Good algos are now essential for every major volume trader, as they dramatically reduce costs by finding the most liquid pools of stock, the best spreads, the shortest latency times, and the cheapest fees, all while performing an array of transactional analyses in a fraction of the time it would take a human trader to do so. VWAP (Volume Weighted Average Price) and TWAP (Time Weighted Average Price) are among the simplest of algorithmic strategies, and are used as benchmarks in many circles.

"For single-stock traders ... algo trading can really improve workflow by applying a more macro-approach to trading--thinking about the stock rather than the order," says one prime brokerage manager at one of Japan's largest securities houses.

Tweaking the technology

Developing, testing, implementing and managing such sophisticated software is not cheap, and can easily run into the millions of dollars--without providing any guarantee as to reliability or long-term viability, making it a truly high-stakes business. Demand for ever more sophisticated and more suitable algos for specific markets is constant, but differences and peculiarities between markets--including auction processes, tick sizes, bid/ask spreads, multiple currencies and the allowability of short selling and so on--are significant enough to make good algos far from universally applicable. The upshot: what works on the NYSE might fail miserably on the TSE. Even trading protocol standards can differ.

Most algos are developed in the US, but that alone constitutes no kind of guarantee. "The best algos are often difficult to localize," says John Honeyman, VP of Global Execution Services at JPMorgan. "It's worthwhile to develop a Japan-specific structure in Japan, but you have to remember that Hong Kong, China, South Korea and so forth are all again different."

Algo trading is such a complex business that many who use the technology are challenged to grasp its full potential, say some industry insiders. It would certainly help explain how a boutique market for software tools to make algos easier to handle has rapidly developed. Bloomberg and Quick were among the early players to offer standard solutions, but the dire need for nimble approaches, that can adapt with the algos themselves, has kept this space open to fresh ideas.

Into this void has stepped newer solutions providers such as TradingScreen, MetaBit, and Tora Trading Systems, each of which feature innovative answers to problems such as server hosting, software platforms, Java-enabling and market access. This makes life easier for hedge funds and prime brokers who may wish to borrow and lend securities in large volumes across asset classes and currencies in multiple markets simultaneously.

"People will come to recognize the benefits of using an electronic front end," says one trade software vendor. "If the electronic trading market grows, then we grow."

While short-term volatility has stirred concerns as to where many financial markets are headed, nearly all agree that participation in Japan's markets is headed upwards long-term.

"Electronic trading, algo use, liquidity pools, access and efficiency will all go up, while costs fall," says one mid-sized Japan hedge fund manager. "At some point, we will see consolidation, but for now, this market should be one to watch."
